To improve the efficiency and effectiveness of the health care system, the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Public Law 104-191, included Administrative Simplification provisions that required the United States Department of Health and Human Services (HHS) to adopt national standards for electronic health care transactions and code sets, unique health identifiers, and security. At the same time, Congress recognized that advances in electronic technology could erode the privacy of health information. Consequently, Congress incorporated into HIPAA provisions that mandated the adoption of Federal privacy protections for individually identifiable health information (HHS, 2013). PHI includes both medical information regarding your care and treatment and individually identifiable personal information that may include your name, address, telephone number, social security number, and other personal information that you provide to us in the course of your treatment. This information may be written, oral, and/or electronic in nature. We understand the importance of safeguarding this personal information and are committed to the protection of all protected health information. H2 Homecare requires all business associates and contractors to sign a Confidentiality Agreement to further safeguard your personal protected health information.
At H2 Homecare, we create a medical record (both written and electronic) of the care and services that are provided to you in accordance with the law. Our privacy policy applies to all records and information obtained in the course of your care. Changes in our privacy practice may occur as new laws and regulations become effective. You will be provided with a new version of this form in the event that our privacy statement changes in accordance with applicable laws.
CLIENT RIGHTS REGARDING PERSONAL PROTECTED HEALTH INFORMATION
You have the right to access, inspect, and obtain a copy of your personal protected health information by sending us a written request on the Request for Medical Records form. This right applies to most medical and billing information. Reasonable copying and mailing charges may apply. Advance notice as to the availability of an H2 Homecare employee for the purpose of copying of your review would be appreciated.
